ENDORSED LETTER addressed to Judge Gerard E. Lynch from Matthew J. Morris and Michael D. Tiger dated 10/23/2006 re: to Mr. Moawad does not oppose an appropriately finite extension of jurisdictional discovery for his deposition and any other discovery in Lebanon Dr. Ayyash obtains before that deposition, Mr. Moawad does not consent to Dr. Ayyash's proposal to move the case on the suspense docket, or to any further discovery outside of Lebanon. There has never been any basis for the Court to exercise personal jurisdiction and the discovery Dr. Ayyash has already taken does not furnish such a basis. Mr. Moawad, who continues to litigate his business dispute with Dr. Ayyash in the Lebanese courts (of which Dr. Ayyash has freely availed himself) is entitled to have the jurisdictional issues in this case adjudicated without the further delay Dr. Ayyash seeks. ENDORSEMENT: In the face of defendant's motion to dismiss for lack of jurisdiction, this court granted plaintff a limited window to take jursiction I discovery. Such an opportunity is not a Guarantee of a successful investigation plaintiff ask that this can be put on further hold for six months due to difficulty in obtaining document from War-Torn Lebanon and from Sluggishly responding European countries. That request will be denied. Litigation in this country cannot be put on indefinite hold pending events in other countries that are not within this Court?s or this litigants? control. In any event, the cuticle question here is the connection of the alleged found to the United States. A reasonable extension to allow the competing of Moawad?s deposition, and to allow further time for document to arrive from other countries, is another matter.
